Once was the outgoing governor, but he quickly gave up his fight for the seat once the case moved tot he Supreme Court. The court decided the lieutenant-governor elected with Eugene Talmadge should get the seat.

In the Georgia gubernatorial poll of November 1946, the Democratic contestant and former Governor “Eugene Tallmadge” won the election. But unluckily, he died later in mid-December, before his programmed oath ceremony in January 1947. His death created the three Governors dispute in Georgia.

Thompson urged the “General Assembly” to confirm the election result before addressing the issue that who should be appointed as the governor. Once the documentation was done, Thompson would have a stouter claim, as he was Lieutenant Governor at that time, but Tallmadge’s became successful in postponing the certification. On 15th January 1947, the General Assembly designated Herman Tallmadge as the governor.
